1. Introduction and Acceptance of Terms

Welcome to KalibGO Courier (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, [kalibgo.com] (the “Site”), and all services, content, and features offered by us, specifically including freight forwarding, shipping, logistics, and courier services from the United States to Jamaica (collectively, the “Services”).

By accessing our Site, creating an account, booking a shipment, or using our Services in any way, you (“Customer,” “you,” “your”) acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Shipping Policy, all of which are incorporated herein by reference.

If you do not agree to these Terms, you must not use our Site or Services.

2. Definitions

  • “Customer” means any individual or entity that uses our Services.

  • “Shipment” means any package, parcel, box, crate, or item tendered to the Company for transportation.

  • “Prohibited Items” means items we do not accept for transport, as detailed in Section 6.

  • “Restricted Items” means items we may accept under specific conditions, as detailed in Section 6.

  • “Declared Value” is the value you assign to your shipment for the purposes of limited liability, not to be confused with insurance.

  • “Customs Brokerage” refers to our service of facilitating the clearance of your shipment through Jamaican customs.

3. Services Description

We provide door-to-door and port-to-port freight forwarding and courier services from the United States to Jamaica. Our Services typically include:

  • Providing a US-based address (virtual mailbox) for receiving your goods.

  • Consolidation of multiple packages.

  • International air or sea freight transportation to Jamaica.

  • Customs brokerage and clearance in Jamaica.

  • Final delivery to an address in Jamaica (for door-to-door services).
    You are responsible for providing accurate and complete information for all stages of the shipping process.

4. Customer Account

You may be required to create an account to use certain Services. You are responsible for:

  • Maintaining the confidentiality of your account credentials.

  • All activities that occur under your account.

  • Providing accurate, current, and complete information.
    You must notify us immediately of any unauthorized use of your account.

5. Shipping Process & Customer Responsibilities

5.1. US Address Use: The US address we provide is for receiving goods you have purchased. It is not a residential address and may not be used for personal mail, voter registration, or establishing legal residency.
5.2. Receiving Goods: We will receive and store your goods at our US warehouse pending shipment. Storage may be subject to time limits and fees, as outlined in our Shipping Policy.
5.3. Shipping Instruction: You must submit a shipment pre-alert through your account for each shipment, declaring the contents, quantity, and value accurately.
5.4. Accuracy of Information: You are solely responsible for the accuracy and completeness of all information provided, including recipient details, item description, quantity, and declared value. Incorrect information may result in delays, additional fees, or seizure of goods by customs.
5.5. Packaging: Goods should be securely packaged by the merchant or you to withstand international shipping. We may repack items at our discretion for safe transport, which may incur a repacking fee.

6. Prohibited and Restricted Items

ABSOLUTELY NO SHIPMENT MAY CONTAIN THE FOLLOWING PROHIBITED ITEMS:

  • Hazardous materials (e.g., explosives, gases, flammable liquids/solids, aerosols).

  • Weapons, firearms, ammunition, and parts.

  • Narcotics, illegal drugs, and drug paraphernalia.

  • Currency (banknotes, coins, securities).

  • Perishable food items.

  • Animals, plants, and endangered species.

  • Pornographic or obscene material.

  • Counterfeit or pirated goods.

  • Items whose importation is banned by Jamaican law.

RESTRICTED ITEMS (Subject to Prior Approval & Specific Conditions):

  • Alcohol and tobacco products (require Jamaican import licenses and duties paid).

  • Pharmaceuticals and medications (require permits from the Jamaican Ministry of Health).

  • High-value items (e.g., jewelry, precious stones, antiques).
    Shipments found to contain Prohibited Items will be refused, abandoned, or destroyed without compensation. We assume no liability for Restricted Items shipped without prior written approval.

7. Customs, Duties, and Taxes

  • Jamaica is our destination country; therefore, Jamaican customs laws and regulations apply.

  • You appoint us as your agent for the purpose of customs clearance.

  • You are solely responsible for all import duties, taxes (GCT), customs fees, and any other charges levied by the Jamaican government on your shipment.

  • These charges are not included in our shipping quotes unless explicitly stated.

  • We will pay these charges on your behalf to the relevant authorities and will invoice you for reimbursement before the shipment is released for final delivery. Payment of these charges is mandatory for delivery.

8. Pricing, Invoicing, and Payment

  • Our shipping quotes are based on dimensional weight or actual weight, whichever is greater.

  • Quotes are valid for a limited time and are subject to change due to currency fluctuations, fuel surcharges, and changes in carrier rates.

  • You agree to pay all invoices for shipping charges, customs duties, taxes, and any other applicable fees in full before delivery is completed.

  • We accept payment via Debit Card or Bank Transfer.

  • If an invoice balance remains open for more than 21 days from the date of issue, a flat-rate late payment charge of JMD $300 will be applied to the outstanding balance.

9. Limited Liability and Claims

9.1. Liability Limit: Our liability for loss, damage, or delay is strictly limited. Unless you purchase additional insurance (see 9.2), our maximum liability is USD $100.00 per shipment or $20.00 per kilogram, whichever is lower.
9.2. Insurance: We offer optional third-party insurance for an additional fee. The terms and conditions of the insurance policy will govern any claim. You must declare the full value of your goods to purchase insurance.
9.3. Claims Process: Any claim for loss or damage must be submitted in writing to us within three (3) days of the delivery date (or the expected delivery date for lost shipments). You must provide proof of value (original receipt/invoice) and photos of the packaging and damaged goods. No claim will be processed if outstanding invoices are unpaid. If the client fails to check his/her package(s), before accepting delivery, any claim made in respect to damages will not be honoured. Packages that have been identified as damaged or incorrect not caused by our representative(s), the process of returning the item to the supplier will be the sole responsibility of the client.
9.4. Force Majeure: We are not liable for any delay or failure in performance resulting from acts beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor or materials, or delays at customs.

10. Delivery

  • We will deliver to the address provided in your shipping instructions.

  • Someone must be available to receive the shipment. If no one is available, a re-delivery fee may apply.

  • You are responsible for ensuring the address is accessible and correct. We are not liable for failed deliveries due to incorrect addresses.

  • Delivery timelines are estimates only and are not guaranteed.

11. Indemnification

You agree to indemnify, defend, and hold harmless KalibGO Courier, its affiliates, officers, and employees from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your breach of these Terms.

  • Your violation of any US or Jamaican law or regulation.

  • The nature of the items in your shipment (e.g., claims from customs for undeclared restricted items).

  • Incorrect information provided by you.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Jamaica without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be exclusively resolved in the courts located in Jamaica.

13. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. The most current version will be posted on our Site. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.
